The eviction of tenants is always a last resort, but unfortunately last year we had to evict an average of around 13 tenants every month last year. The reasons for these evictions included squatting, rent arrears and Antisocial Behaviour.
If you are a tenant or about to become one, please read the following information carefully to reduce the chance that you might be involved in such a situation.
We will use all other options before proceeding with eviction and we are here to help if you ever find yourself in any difficulty.
Only organisations which have a mortgage over a property can institute repossession proceedings.
We will normally take possession proceedings (under the Housing Act 1985) rather than repossession proceedings if a tenant breaches their tenancy agreement because they are public sector tenants.
Possession proceedings may begin for non-payment or Antisocial Behaviour. This can lead to an order for possession or a suspended possession order. The order for possession leads to an eviction not repossession.
The suspended order remains over someone to make sure they comply with for example, rent arrears (they may be asked to pay their rent plus £10 per week to deal with the arrears - if they don't keep it up then we go back to court and ask for a full order and will lead to an eviction).
