Complaints against Members of the Council

 

The complaints procedure

The responsibility for considering complaints that an elected Member of the Council (local councillor) may have breached the Members' Code of Conduct has transferred from the Standards Board for England to the standards committees of local authorities.

 

What this means to you

If you want to complain about the conduct of a Member of the London Borough of Barking and Dagenham, you should send your written complaint marked Private and Confidential to:

The Monitoring Officer will refer the complaint to a sub committee of the Council's Standards Committee, who will decide whether the matter is one which should be investigated.

 

If the sub committee feels that an investigation is not warranted, you will have a right for that decision to be reviewed by a different sub committee of the Standards Committee.

 

Where investigation is found to be warranted, the Monitoring Officer will arrange for a full investigation and this will subsequently be reported to and determined by a sub committee of the Standards Committee.

 

The Standards Committee can only deal with complaints about the behaviour of a Member. It will not deal with complaints about things that are not covered by the Members' Code of Conduct. If you make a complaint it must be about why you think a Member has not followed the Code of Conduct.

 

Every complaint received about the behaviour of Members must be considered but vexatious or malicious complaints will generally not be investigated. Where the Monitoring Officer considers that the same complaint from the same complainant has already been considered by the Standards Committee such complaint will not be referred again to the Standards Committee for assessment.
