Local Land Charges main objective is to provide a quality service at all times that is value for money by completing search applications for our customers buying commercial or residential properties within our boundaries in a timely and professional manner.

Important information about the new search forms and our procedure
Please note: The CON29 Part 1 and 2 Search Forms (2002) Edition have now been replaced as from the 1 August 2007. 

The new forms are now to be known as the CON29R 'Required' and the CON29O 'Optional' (2007) Edition. 

These forms are available from your law stationery suppliers. 

What is a Local Land Charge Search?
As a potential buyer of property, land, commercial or industrial premises in Barking and Dagenham, you will need to be aware that, as part of the conveyancing process a local authority Local Land Charges Search against the property must be undertaken. 

The reason for the search is to find out whether there are any restrictions or legal obligations registered against the premises. 

All the information required for the Local Land Charges Register and replies to the CON29R form are supplied to the Local Land Charges section by other council services such as:

  • Planning
  • Building Control
  • Housing and Health
  • Highways
  • Other government / outside bodies
  • We accept searches by:

    • Post
    • By hand
    • Electronically by National Land Information Services

    Please ensure that when sending in your search application to us that this is done so with:

    • 2 x LLC1 forms
    • 2 x CON29R forms
    • 2 site location plans of the area you are searching
    • A company cheque made payable to 'London Borough of Barking and Dagenham', with the correct fee, signed and dated to avoid any unnecessary delays

    Types of searches we offer
    We carry out the following searches:

    • LLC1 only search
    • CON29R 'Required' search
    • CON29O 'Optional' search
    • Or any combination of the above
    • Personal search of the register
    • National Land Information Service / Land Data-Electronic
    • Search for Common Land and Village Green Information is now Question 22 on the CON29O form

    Type of information we provide on a full local authority search, which consists of LLC1 and CON29 Forms 'Required' and 'Optional'.
    A typical search completed by the Local Land Charges Section will tell you information about the property that you are buying.

    Examples of information given are as follows:

    • Planning history of the property
    • Conservation areas
    • Tree preservation orders
    • Listed building status
    • Certain legal agreements
    • Improvement grants
    • Financial charges imposed by the council
    • Council or state road or rail schemes within 200 metres of the property
    • The designation of the property in our Local Development Framework
    • Maintenance of roads given in the property address
    • Compulsory purchase orders made by the council
    • Smoke control orders

    Search forms
    An Official Local Authority Search can be made up of two separate forms as shown below. You will need to send to us a completed original and a duplicate copy of each of the forms you wish to use for your search.

    • The LLC1 form is a search of the Local Land Charges register only and includes copies of any register entries for the property
    • The CON29 (Conveyancing 29) form (2007) edition raises standard required and optional enquiries about the property

    The LLC1 and CON29 forms are held by solicitors or conveyancers and can also be obtained from law stationery suppliers. 

    The Local Land Charges Register
    The Local Land Charges Register is held by the Local Land Charges section in the Town Hall, 1 Town Square, Barking, IG11 7LU. 

    The Register consists of 12 Parts, and is regularly updated as and when new charges and amendments are made. 

    The 12 Parts are:

    4. Part IV - Miscellaneous Charges
    5. Part V - Fenland Ways Maintenance Charges
    6. Part VI - Land Compensation Charges

    8. Part VIII - Civil Aviation Charges
    9. Part IX - Opencast Coal Charges
    10. Part X - Listed Building Charges
    11. Part XI - Light Obstruction Notices
    12. Part XII - Drainage Scheme Charges

    National Land and Information Service/Land Data - An Electronic Search
    The Local Land Charges Section has now embraced the National Land Information Service and has been awarded Exemplar Status. This means that you are now able to send your search requests and receive them back electronically.

  • We aim to turnaround 100% standard searches within one to five working days from the date of receipt of the LLC1 and CON29 forms. Typically turnaround times are one to three days for a full search. 

    Cancellation of searches

    Please note: No search can be cancelled after 1pm on the day we receive it, as this is our deadline for cancellations. 

    Personal searches
    Personal searches are made by appointment only, between  10am - 12pm and 2pm - 4pm. These must be booked 24 hours in advance by contacting Local Land Charges at the number and address shown. 

    An accurate location plan clearly outlining the property being searched is required. 

    Please note: Appointment booking times are 8.30am - 12pm and 2pm - 3.30pm. 

    The London Borough of Barking and Dagenham, Local Land Charges section has been and will continue to operate until further notice in accordance with the (2005) 'Personal Search Guidance for Local Authorities and Personal Searchers'.

     
  • In line with the 2008 regulations, the following fees apply when requesting a search:

    • Full search (LLC1 and CON29R) - £150
    • LLC1 only search - £67.50 and £1 for each additional parcel of land up to a maximum additional charge of £16
    • CON29 Required (numbers 1-3.13) - £82.50
    • CON29 Optional (numbers 4-22) - £16 each
    • Additional parcel of land on a full search - £25 each
    • Common land and village green search only (Question 22 on CON29O)- £16
    • Copies for documents as a result of a search - £1.50 for the first page and 10p per page thereafter
    • Copy of search results - £29.38 each

    These fees are valid until 31st March 2014

    Additional parcel of land
    An additional parcel of land is a separate part of a building (for example a flat above a shop) or a building adjoining the property being searched upon. 

    Personal Searches
    The Local Land Charges Register is available for inspection at Barking Town Hall. Please phone in advance to make an appointment, this is not essential but will reduce any time that you may have to wait.  There is no charge for this service. Please note that information supplied is subject to Sections 12 & 13 of the Environmental Information Regulations and the Local Government Act 2003 where applicable.

    Other fees
    We can provide you with copies of documents revealed as a result of a Local Authority Search completed by us for a fee of £1.50 for the first page and 10p per page thereafter, please quote the search reference given on the search when requesting copies. 

    Access to additional information
    Information which forms part of public registers can be inspected as follows. (The CON29R question numbers are included for easy reference). 

    Questions 1 (All parts), 2a, 3.1, 3.5, 3.7a, 3.8, 3.9, 3.10 and 3.11
    All public planning and building control records plus a map of adopted roads are available for inspection between the hours of 9am - 4.45pm at the Town Hall, 1 Town Square, Barking, IG11 7LU by contacting our Planning Reception on 020 8227 3933.

    The local authority is not responsible for maintaining public sewers/water supply records. To purchase a Con29DW drainage and water search please contact Thames Water.

    Question 3.12
    Planning services has a map of Previously Developed land for inspection at the Town Hall, 1 Town Square, Barking, IG11 7LU by contacting our Planning Reception on 020 8227 3933. The Contaminated Land register is maintained by Environmental and enforcement services based at Roycraft House (15 Linton Road, Barking, IG11 8HE). They can be contacted via Barking and Dagenham Direct on 020 8215 3000.

    Question 3.13
    There are no 'Radon Affected Areas' in Barking and Dagenham.

  • Do you expedite searches?
    We do not expedite searches, but if your search is urgent then please contact us so that we can do all we can to help you and your client. We currently complete and dispatch searches within one to three working days.

    Do you need plans?
    We ask that you submit with your search application two site location plans clearly marking the area that you want us to search on. This not only helps us but also ensures that the search application is not delayed.

    Do you do landfill searches?
    No. This information is available for a fee of £50 + vat. You must also contact Environmental Protection on 020 8227 5691.

    What is your fee?
    Our current standard search fee is £150.

    What is your commercial search fee?
    Our commercial search fee is also £150.

  • The Local Land Charges service aims to provide a fast, accurate and responsive service at all times. 

    We have invested in a fully computerised Local Land Charges system CAPS - TLC which became fully operational on 1 April 1999.  

    Searches also include information as to where to inspect documents or obtain copies.
