Untidy (eyesore) gardens

Waste in front gardens is not tolerated in Barking and Dagenham, it’s an eyesore and no more acceptable than someone fly-tipping on the street.

Residents need to act in a socially responsible manner and take pride in their borough.

  • overgrown hedges
  • rusting cars
  • rotting mattresses
  • piles of rubbish

These make the whole street look like a tip and residents have told us they want action taken against this form of anti social behaviour.

We offer a bulky waste collection service for residential properties as well as access to a household waste recycling centre so there is no excuse for treating your front garden like a dumping ground.

We have powers to deal with untidy gardens or land in certain circumstances:

  • there is material which can rot and cause a nuisance to neighbours or attract rats or mice, like:
    • discarded foodstuff
    • faeces
    • nappies
    • dead animals
  • there is shelter for vermin such as rats or mice
  • the land is considered by officers to be detrimental to the local amenity
  • there are materials which are just unsightly and unlikely to be causing a statutory nuisance


Enforcement patrols are out in the borough identifying homes with untidy gardens.

Residents with untidy gardens will initially be issued with a warning letter that will require them to clear and tidy their garden within a specific period of time.

Failure to comply with the letter will result in the Council issuing a Community Protection Notice under the Anti Social Behaviour, Crime and Policing Act 2014.

Failure to comply with the notice may result in a £100 Fixed Penalty Notice (FPN) being issued to the Owner/occupier of the land.

Failure to pay the FPN will result in prosecution and owners can face fines of up to £2,500.

We will charge for all reasonable costs incurred to those properties where enforcement action is taken.

The enforcement process for an eyesore garden can take up to six months to fully investigate and resolve. Updates cannot be provided due to data protection rules.
