Street traders

You need a licence issued by the council in accordance with Part III of the London Local Authorities Act 1990, if you wish to carry out any of the following activities in Barking and Dagenham:

  • trade from a stall or stand in Barking Town Centre Market
  • trade immediately outside or on the forecourt of a shop on the public highway (including the footpath)
  • place tables and chairs outside a food and drink premises on the public highway (including the footpath)
  • trade from a mobile vehicle
  • trade on private land if it is within 7m of the public highway (including the footpath),

Anyone carrying out street trading without a valid licence is committing an offence and is liable to receive a fixed penalty notice to pay £150 and/or to be fined up to £1000 on prosecution.

You do not need a licence to trade on the forecourt of your shop if the forecourt lies entirely within the freehold of the premises.

    Barking market

    Barking Town Centre Market is open from 8.30am to 5pm on Tuesdays, Thursdays, Fridays and Saturdays throughout the year and is additionally open on Mondays during December.

    To trade in the market, you will need:

    • a proper market stall frame - we do not currently provide these for hire but may provide gazebos and display tables subject to availability
    • stall cover sheets and clips, etc. to secure the sheet to the frame
    • display stands, tables, etc.
    • or a purpose built or adapted vehicle, trailer or stand

    There are two types of licence available if you wish to trade at the Market:

    1. A casual licence permits trading on a one-off, occasional or ad hoc basis and may be granted on application to the Market Manger on or before the day of intended trade and on payment of the pitch rental fee.
    2. A regular licence permits ongoing trading on the days and in the locations specified in the licence and may be granted on application and payment of three week’s pitch rental fees in advance in addition to the payment of pitch rental fees on each day of trading.

    Fees

    Individual pitch sizes are generally 3m x 4.25m (10ft x 14ft) and 4.5m x 4.25m (15ft x 14ft). Pitch rental is charged pro rata per 3m width.

    Fees may be paid by debit or credit card to the Market Manager or in cash at Barking Learning Centre. Payment by cheque is not accepted.

    Regular licence

    Before the grant of a regular licence, you will need to pay three weeks’ pitch rental fees in advance for the days you wish to trade. You must then pay the daily fee on each day that you trade.

    Regular licence holders are liable for payment of pitch fees for every day for which they are licensed to trade, even if they do not in fact trade on any day, unless agreed in advance by the Market Manager.

    You will need to provide the following with your application:

    • proof of valid public liability insurance with minimum liability cover of at least £2,000,000 (two million pounds)
    • a digital photograph of any person named on the application form (individual applicant, designated manager or assistant)
    • a copy of photo id and/or proof of the right to work in the UK for any person named on the application form (individual applicant, designated manager or assistant)
    • proof of home address for any person named on the application form

    Street trading

    You do not need a licence to display or sell goods on the private forecourt of your own shop premises, but you may not rent or otherwise permit the use of your forecourt by any other trader for the display or sale of their goods.

    Street trading licences will only be granted for trade in streets designated as licence streets.  Street trading will not be permitted immediately outside Barking Station.

    Mobile vehicles will only be licensed to trade from a static location. The council will require proof of the landowner’s permission where the location is on private land.

    Street trading licences (shopfront and tables & chairs) are granted for a maximum period of one year. All licences expire on 30 June each year regardless of when they were granted. Licence holders who wish to continue street trading must submit a new application at least one month before the expiry of their current licences.

    Fees

    Fees may be paid by debit or credit card by telephoning the Street Trading Team on 020 8724 8898. 

    Once an Environmental Enforcement Officer has visited and measured the shop frontage/depth, the license fee will need to be paid in full before it will be processed. You must not trade on the street until the license has been issued and is in your possession.

    Fees are non-refundable.

    Licences are non-transferable. 

    Shopfront / tables / chairs

    Street Trading priced per Square Metre and the standard charges are:

    • £100 per sq metre for the first two metres
    • £30 per sq metre for every metre thereafter

    Mobile vehicle

    Annual license fee - £349.50

    An officer of our Environmental Enforcement Team will need to visit your premises to assess suitability and measure the shop frontage/depth before granting any Street Trading licence.

     

    FAQs

    How long does the licence last?        
    All licences run from 01 July to 30 June every year. If you apply half/part way through the year, you will still pay the full amount

    Where can I place my mobile vehicle to trade?
    We are not able to provide locations within the borough but if you send us pictures of the location you would like to trade we will consider it and let you know.

    When can I reapply for my licence?        
    We recommend that you reapply for your licence at least a month before it is due to expire. 

    How much does the license cost?        
    Our fees and charges are based on our website. Our fees are based on the suqare meterage of the shop frontage of where you want to trade. 

    Is the license transferable?        
    No if the license holder needs to change then a new application will need to be applied for. 

    Is the license fee refundable?        
    No the license fee is non-refundable. 

    What documents are required?        
    We require the following documents:

    • A complete application form
    • Waste Transfer Notes
    • Photo ID
    • Proof of address (letter form)
    • Public liability Insurance

    What goods can I display?        
    You can only display commodities that are sold in your shop and stated on the license.
