How the revenue collection service works

Introduction

This privacy notice explains how the Council collects, uses, shares and protects personal data when administering and collecting Council Tax, Business Rates (National Non-Domestic Rates), Housing Benefit Overpayment, Sundry Debt including leasehold service charges. It also explains your rights under data protection law.

Data Controller

The Council is the Data Controller for the personal data processed for revenue collection purposes. The Council’s Data Protection Officer (DPO) can be contacted for queries relating to this notice or the handling of your personal data.

Information We Collect

We may collect and process the following categories of personal data:

  • Name, address (current and previous) and contact details;
  • Date of birth, National Insurance number and proof of identity;
  • Property, tenancy, ownership and leasehold information;
  • Financial information, including income and capital details, payment history and bank details;
  • Information obtained from employers, landlords, managing agents, government bodies and enforcement agencies where legally permitted.

How We Use Your Information

Your personal data is used to:

  • Administer Council Tax, Business Rates, Housing Benefit Overpayment, and Sundry Debt accounts;
  • Calculate liability, discounts, exemptions, reliefs for Revenues Collection.
  • Issue bills, notifications, overpayment invoices, reminders and statutory notices;
  • Collect payments, recover arrears across Revenues Collection
  • Take recovery or enforcement action where necessary;
  • Prevent and detect fraud and protect public funds;
  • Comply with legal and regulatory obligations.

Automated decision-making

Revenue and Collections will never make automated decisions using your data.

In order to improve the services we provide to residents, we use your information in different ways, this is known as data analytics. We bring together information from a range of services and sometimes partner organisations to understand more about the needs of those living in the borough.

Lawful Basis for Processing

The Council processes personal data under the following lawful bases in the UK General Data Protection Regulation (UK GDPR):

Article 6, 1(e) public task Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Article 6, 1 legal obligation Processing is necessary for compliance with a legal obligation to which the controller is subject. 
Article 9, 2(g) special categories Processing is necessary for reasons of substantial public interest, on the basis. 

Legislation and Regulatory Framework

The main legislation under which the Council collects and uses personal data for these purposes includes:

Information Sharing

We may share your personal data, where lawful and necessary, with:

  • Other Council services;
  • The Valuation Office Agency;
  • Department for Work and Pensions and HM Revenue & Customs;
  • Landlords, managing agents and registered providers (where relevant to benefit or service charges);
  • Courts, tribunals and enforcement agents;
  • Police, Health and Social care organisations;
  • Contractors and partners acting on our behalf under data protection agreements.

On occasions, your information may be accessed by contracted IT support organisations in the delivery of IT support for both the IT infrastructure and associated systems, for the processes detailed in this privacy notice. Access by IT support will only be for such reasons as fixing any technical issues with software, and any viewing of data will be incidental to this.

We will not share your information with organisations unless there is a legal gateway to do so. However, there may be certain circumstances where we would share without

International Transfers

Personal data is not routinely transferred outside the United Kingdom. Where any transfer is required, appropriate safeguards will be applied.

Data Retention

Your personal data is kept only for as long as necessary, in line with statutory requirements and the Council’s retention schedule.

Your Rights

You have rights under data protection law, including the right to:

  • Access your personal data;
  • Request correction of inaccurate or incomplete data;
  • Request erasure or restriction of processing where applicable;
  • Object to processing in certain circumstances;
