A judge has ordered a Dagenham Cash & Carry to pay a fine of nearly £1,000 for breaching its Street Trading Licence.



Gabreb Cash & Carry, 274 Heathway was visited by Barking and Dagenham Council’s street enforcement officers on 9 December 2020, who discovered that fruit and veg stalls located directly outside the shop exceeded the two metres allowed by the Street Trading Licence.



The business was aware of the legal requirements as they had previously been visited by council officers, however they continued to allow the stalls to measure out to 2.62 metres, partially blocking the pavement and making it difficult for people walking, wheelchair users and anyone with a pushchair to get past.



Mr Mohib Ullah, who is responsible for the fruit and veg stall alleges he was out of the country for 11 months and claimed he did not receive the notices until he returned home. However, the case went to Barkingside Magistrates’ Court on Tuesday, 16 November where Mr Ullah pleaded guilty.

Mr Ullah must now pay a fine of £307, costs to Barking and Dagenham Council of £559 and a Victim Surcharge of £34.



Councillor Margaret Mullane, Cabinet Member for Enforcement and Community Safety said: “Rules and regulations are put in place for a reason and we expect all businesses to follow them.



“When shops also have stalls directly outside, this takes up valuable space for passers-by and can be a real obstruction for anyone with a pushchair or wheelchair, so it is important that they stick to the limit they’re allowed and don’t cause unnecessary issues for residents.”
