Following numerous complaints of dogs barking on 9 February 2024, the council’s Environmental Enforcement Officers visited the property on Corwallis Road Dagenham and witnessed extreme noise coming from the house.
The officer determined it to be a statutory nuisance and issued an Abatement Notice, to the occupier Mr Syed Uzeir Iqbal. The Notice requires the individual to abate (stop) the nuisance by a certain date and may require them to prevent it from happening again.
After further inspection it was noted that the property was being used for kennelling of security K9 dog units.
The council received further complaints of excessive noise from the property and on the 13 June 2024, a breach of the Abatement Notice was witness by a council officer.
As a result, a Fixed Penalty Notice of £150 was issued, offering the property owners the opportunity to discharge their liability by paying the fine within 14 days. Despite a reminder letter sent on 2 July 2024, the penalty remained unpaid.
On 25 September 2024, a final notice of intended prosecution was issued. With no payment received, the fixed penalty notice was withdrawn, and a summons was issued for prosecution of the original offence of failing to abate a statutory nuisance.
The case took place at Barkingside Magistrates Court on 28 January 2025 where Mr Iqbal failed to attend and he was found guilty in his absence.
He was ordered to pay a fine of £660 within 28 days, costs to Barking and Dagenham Council of £1,001.74 and a Victim Surcharge of £262, totalling £1,923.74.
