ASB Case Review

If you have reported the same issue on three separate occasions within the past six months to the Police, the Council, or your housing provider and feel that no action has been taken, you can request a review called the ASB Case Review. 

The ASB Case Review is a process that allows agencies to reassess their response to incidents of anti-social behaviour or hate incidents that have been reported. Please note that this is not a complaints procedure. 

If your application meets the necessary criteria, an ASB Case Review meeting will be scheduled as soon as possible, within 21 days (or 28 days if an independent chair is required). Recommendations may be provided in the form of an action plan to address the anti-social behaviour.

Anti-social behaviour, crime and policy act 2014

The legislation used to investigate and action reports of Anti-Social Behaviour (ASB) is the Anti-social Behaviour, Crime and Policing Act 2014.

The legislation requires the relevant local agencies to be satisfied that the specific legal tests and safeguards set out in the legislation are met before the 2014 Act powers are used.

Part one, section 2 defines ASB as:

  • conduct that has caused, or is likely to cause, harassment, alarm or distress to any person,
  • conduct capable of causing nuisance or annoyance to a person in relation to that person’s occupation of residential premises, or
  • conduct capable of causing housing-related nuisance or annoyance to any person.
