Barking man fined over planning breach at Dagenham property

A Barking resident has been fined more than £3,200 after being found guilty at Barkingside Magistrates’ Court for failing to comply with a Breach of Condition Notice relating to an extension at a property in Dagenham.

On Tuesday 11 November 2025, Mr Ezikiel Ose Peterson-Ugowe of Castle Road, Barking, was convicted after trial for an offence under Section 187A of the Town and Country Planning Act 1990.

The case concerned a property on Homestead Road, Dagenham, where planning permission granted in July 2023 for a ground floor extension included conditions requiring internal access from the original building and an external finish matching the existing structure.

An inspection by Barking and Dagenham Council’s Private Sector Housing team in May 2024 raised concerns, and a subsequent visit by Planning Enforcement officers confirmed the extension had been built as a self-contained unit with no internal access and that it had been finished in red brick, contrary to the approved plans.

Despite being served with a Breach of Condition Notice in August 2024, and being given six months to comply, a follow-up inspection in May 2025 found no changes had been made. 

As a result, Mr Peterson-Ugowe was summoned to Barkingside Magistrates court on Tuesday 11 November where the court imposed the following penalties:

  • Fine: £934
  • Victim Surcharge: £374
  • Prosecution Costs: £1,962
    Total: £3,270

A collection order was made for payment at £200 per month, starting 9 December 2025.

Councillor Syed Ghani, Cabinet Member for Enforcement and Community Safety, said: "Planning rules exist to protect our communities and ensure developments are safe and in keeping with their surroundings. Ignoring these conditions is unacceptable, and this case shows we will take action against those who flout the law."
