Overview

You need a licence issued by the council in accordance with Part III of the London Local Authorities Act 1990, if you wish to carry out any of the following activities in Barking and Dagenham:

  • trade from a stall or stand in Barking Town Centre Market
  • trade immediately outside or on the forecourt of a shop on the Street (including the footpath)
  • place tables and chairs outside a food and drink premises on the public highway (including the footpath)
  • trade from a mobile vehicle OR pop up at an agreed location.
  • trade on private land within 7m of a Street (including the footpath),

Anyone carrying out street trading without a valid licence is committing an offence and is liable to receive a fixed penalty notice to pay £150 and/or to be fined up to £1000 on prosecution.

*You do not need a licence to trade on the forecourt of your shop if the forecourt lies entirely within the freehold of the premises.

Definitions

“Street Trading” Means

The selling of exposing or the offering for sale of any article (including a living thing) or the supplying or offering to supply any service in a street for gain or reward;

“Street” includes –

  1. Any road or footway
  2. Any other area, not being within permanently enclosed premises, within 7 metres of any road or footway, to which the public have access without payment;
  3. Any part of such road, footway or area;
  4. Any part of any housing development provided or maintain by a local authority under Part II of the Housing Act 1985;

“Street Trading Licence” Means

A licence granted and valid for the period specified therein being not less than six months
