Subletting an ex-council property

What is subletting

Subletting occurs when a leaseholder rents out the entire leasehold property to another individual, known as a subtenant, while retaining legal responsibility under the original lease. It is important to know that the property can only be used as a single private dwelling for residential purposes only. Lodgers and multiple occupation are not permitted.

Leaseholder responsibility

Leaseholders are responsible for ensuring their tenants understand that their names will be registered with the local authority to meet their obligations to notify any subletting arrangements. Information registered will include the name and contact details of the tenant. Leaseholders are obliged to notify the authority of any changes to their tenancy arrangements. The information will be kept in line with council retention policies and is subject to all data protection laws with respect to the processing of personal data.

Fees

Please note that our fee for registering your sublet is £224.00. You can choose to pay using one of the following options:

  1. You can pay online by choosing general payments – leasehold payment - drop down menu - legal notice.  Please fill out each section and ensure the full property address is provided and the reference should be the property address.
  2. You can pay by bank transfer, using the following details:

    Sort Code – 30-00-02
    Account number – 01526028
    Reference – Insert [Property address] /SUBLET

Once the online payment has been made, we will receive an automated e-mail confirming the payment.

Following payment by bank transfer, please e-mail the respective team and inform them of the payment date and time, amount of payment and any reference number/s used. This will allow us to trace the payment.

If this is a renewal of an existing tenancy agreement that you have registered with The London Borough of Barking and Dagenham, then you do not need to pay this fee.

How to Register a sublet property

As part of this process, the following information is required within one calendar month of the sublet, we require the following information:

  • a written notice confirming the sublet of the property along with your correspondence address and contact details.
  • a copy of the signed tenancy agreement or lease agreement with the managing agent (If applicable)
  • the full name and address of any letting or managing agent involved, or a statement detailing how the property will be managed, including the number of inspections conducted annually.
  • a copy of the gas safety certificate for the property
  • a valid copy of Electrical Installation Condition Reports (EICR) for the property.

Additionally, you are required to register your property with the Council under the Private Rented Property Licensing scheme, which is mandatory for all rented properties in the London Borough of Barking & Dagenham. Please note that each new tenancy must be registered in the same way. In the case of an extension or renewal of an existing agreement, we require updated contact details for you and your tenants and a signed copy of the tenancy renewal document.
